Welcome to iniye. These Terms and Conditions govern your access to and use of the iniye website at iniye.in (the “Site”) and the purchase of any products offered by us, including sanitary pads, period panties, and pantie liners.
By accessing or using the Site, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree to all the terms and conditions of this agreement, you may not access the Site or use any services.
1. General Conditions and Usage
- Eligibility: By agreeing to these T&C, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority and you have given us your consent to allow any of your minor dependents to use this site.
- Accuracy of Information: We are not responsible if information made available on this site is not accurate, complete, or current. The material on this site is provided for general information only.
- Modifications to Service and Prices: Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension, or discontinuance of the Service.
2. Products and Orders
- Product Description: We have made every effort to display as accurately as possible the colors and images of our products. We cannot guarantee that your computer monitor’s display of any color will be accurate.
- Sale Conditions: We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region, or jurisdiction (including North Malabar, Kerala, India, and other regions). We may exercise this right on a case-by-case basis.
- Order Acceptance: We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. In the event that we make a change to or cancel an order, we will attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made.
3. Payment and Billing
- Accuracy of Billing and Account Information: You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
- Payment Security: All payment transactions are processed through secure third-party payment gateways. iniye does not store or have access to your full credit card or banking details.
4. Shipping and Delivery
- Shipping Address: You are responsible for ensuring the accuracy of the shipping address provided. We are not liable for packages delivered incorrectly due to wrong information supplied by you.
- Risk of Loss: The risk of loss and title for items purchased from iniye pass to you upon our delivery to the carrier.
- Delivery Timeframes: Any shipping dates or times provided are estimates and are not guaranteed.
5. Returns, Refunds, and Replacements
- Hygiene Policy: Due to the hygienic nature of our personal care products, we strictly adhere to the terms outlined in our separate Refund & Replacement Policy.
- No Returns on Used Products: For the safety and hygiene of all customers, we do not accept returns on products that have been used, worn, or had their individual product seals broken, unless the issue is a verified manufacturing defect reported before use.
- Eligible Conditions: Refunds or replacements are only offered for verified damaged/defective product (before wear), wrong product delivered, missing products, or order not delivered, as detailed in our Refund Policy.
6. Intellectual Property
- iniye Content: All content on the Site, including text, graphics, logos, images, product names, and the compilation thereof, is the property of iniye or its suppliers and is protected by copyright and intellectual property laws.
- Limited License: You are granted a limited, non-exclusive, non-transferable license to access and use the Site for your personal, non-commercial use only.
7. Limitation of Liability
In no case shall iniye, our directors, officers, employees, affiliates, agents, contractors, suppliers, or service providers be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of any of the service or any products procured using the service.
8. Governing Law and Jurisdiction
These Terms and Conditions and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of India, and specifically the laws applicable in the state of Kerala. The courts in District Consumer Disputes Redressal Commission (DCDRC), Kasaragod shall have exclusive jurisdiction over any matter or dispute arising out of these T&C.
